So i have a petty theft from when i was 18 years old i am now 23 and the charge was "withheld adjudication". Anyways i was just recently called for an interview last thursday and got the job. I started on sunday and tomorrow will be my 4th day. On friday i went in to do tax forms and permission for background check. Withhold adjudication means i was NOT convicted of the charge and a question on the backfround said have i ever been convicted of a misdemeanor. I answered no becauae i havent.. Anyways im getting super nervous because i really need this job. So my question is, did they already get the background check back or can i be fired because of the arrest? I got a written arrest and btw i was young and dumb hanging out with the wrong people and i took a 3 dollar nail polish and got caught. I know stupid me.

I'm not sure what kind of info the private sector gets back from a check. I was a HR for the US Govt. Had one case that came back showing an arrest for possession, and another entry after that with a code. When we asked the individual why he didn't show it on his application, he explained that it was before he was 18, and they told him that if he completed a diversion program the arrest would be expunged from his record. So he though it was gone. Turned out that the second entry on the rap sheet was a code saying the first entry wasn't there anymore. Anyway, as long as you answered the question correctly and honestly, you should be OK.

these days you can be arrested for anything but not convicted. Your job will more than likely see a arrest but doesnt know if you were convicted or not. I would be upfront honest at any job. I have a bunch of misdimeanors. The cops here in tx will slap resisting arrest charges on you if they cant find anything to put on u.

You need a better lawyer, Otis.
One that will argue since they had no grounds to arrest you, you were resisting an illegal action - which is legal.

Sort of a "self defense" argument.
