Well! It is not legal, but yes she can refuse to rent as she has all the authority, yes there could be negotiation with the owner of the apartment, manager and you, so try to arrange that. You have to convince them by your words, plan your meeting with the two other wise it is not possible to have the place.

Unfortunately it is legal for landlords to refuse to rent to felons. But it's also legal for landlords to refuse to rent to anyone they don't like--whether it's because of a misdemeanor, having blond hair, wearing an Obama t shirt, whatever. They only thing landlords CANNOT do is discriminate based on things like race, gender, religion, etc. Your son is legally entitled to get back any deposit he put down, but not money for the background check.
